Accident Calls Attention to NY Work Zone Dangers

Published September 20, 2011 by Scott Gottlieb, Injury Law Attorney

A 38-year-old woman was seriously injured after a collision with a van driven by a NY Department of Transportation (DOT) employee on the Thruway near Batavia, NY. The accident occurred on Monday in a construction work zone during the morning rush hour.

State Police on the scene reported that traffic had slowed down to merge on the eastbound thruway when the accident occurred. Our injury attorney in Binghamton, New York emphasize the need for drivers to be aware of approaching work zones and to slow down upon entering the areas.

In 2010, NY State had 497 accidents in road construction and maintenance zones with 202 injuries and 15 fatalities. Earlier this year, our NY injury law attorney warned about dangers in construction zones and asked that drivers heed road signs, merge as soon as signs indicate a lane closure, and keep a safe distance between vehicles.

The accident occurred when the DOT driver noticed a car in his rearview mirror that appeared unable to get over in time into the merged lane. He moved over to avoid an accident at the same time the car driver moved over, resulting in a collision. Four passengers in the vehicle were hurt.

The minivan driver was unhurt. The 38-year-old woman in the car who was seriously injured was taken to Erie County Medical Center via Mercy Flight transport.

Drivers should be aware of changes in traffic patterns and slowing or merging traffic that construction signage reports. Most importantly, stay alert to other drivers who may be speeding or otherwise distracted when road hazards appear.
