Wrongful Death Case Settled In South Carolina
The estate of a 43-year-old man who died in 2005 has settled a wrongful death lawsuit against the county and the Emergency Medical Services for $47,500, just days before the case was to go to trial, reports the Greenville, SC News.
According to the lawsuit, the man suffered a seizure while on a downtown street and EMS was called. The complaint stated that, due to the effects of the seizure, the man was non-responsive when the paramedics arrived and they assaulted him by pushing and shoving him then roughly wrestled him to the ground. His head hit a vehicle’s bumper, causing him to lose consciousness and die.
The defendants denied the assault stating they had to restrain the 43-year-old then he became unresponsive and went into full cardiac arrest. They claimed he died “despite the best efforts of emergency personnel.”
