Rochester Car Accident Victims Improperly Restrained

Published April 21, 2011 by Scott Gottlieb, Injury Law Attorney

Two cars collided head-on Wednesday, resulting in five victims in the two cars sustaining injuries. The accident occurred on Mt. Hope Ave near Averill Ave in Rochester, New York.

A northbound car appeared to have crossed the center line while speeding and struck a southbound vehicle. Rochester Police Lt. Cheryl Fridley reported that four passengers in the northbound car were injured. One of those injured included a child who was not restrained in a child-protective car seat or by a seat belt. The driver of that vehicle, also not wearing a seat belt, suffered a broken leg and was lying in the ground when police arrived.

All 50 states and Washington, DC require child safety seats for infants and children meeting specific criteria. New York law requires that children under eight be restrained in an appropriate child safety seat according to their weight. Our accident attorneys encourage all drivers and passengers throughout New York, including those in Binghamton, to be properly restrained for their own and other’s safety.

Lt. Fridley commented on the child not being properly restrained in the Rochester accident. “The child could’ve easily been thrown from the car, “ she said. “Drivers have to take responsibility of the safety of their passengers and children can’t make that decision for themselves.” The child’s age was not provided.

According to the National Highway Traffic Safety Administration (NHTSA) car crashes are the leading cause of death for children between the ages of three and 14. The likelihood of injuries is twice as high for children not wearing proper restraints. Properly installed child safety seats reportedly saved over 9,000 lives according to the NHTSA during the period 1975 – 2008.

The injury attorneys at Scott C. Gottlieb, Injury Law Attorney, recognize the importance of drivers making sure that all children passengers riding with them are properly restrained in car seats or seat belts. We also encourage drivers to remain alert and aware at all times to other drivers to keep our highways safe.
