Pennsylvania Couple Awarded $2.4 Million In Medical Malpractice Suit

Published November 25, 2009 by Scott Gottlieb, Injury Law Attorney

The Olean Times Herald reports a jury has awarded $2.4 million to a 47-year-old woman and her husband for “ill-advised” surgery in 1998.

In October 1998, the woman went to Olean General Hospital emergency room with abdominal pains. She was diagnosed with an obstructed bowel and was admitted for “conservative medical management.” Her condition improved and her gastroenterologist and surgeon (Dr. Chohan) agreed to keep her on the treatment plan.

The next day, while the gastroenterologist was out of town, Dr. Chohan decided to perform surgery and removed more than 12 inches of her bowel. She spent 88 days in the hospital following the surgery, was readmitted to three hospitals, and underwent two other surgeries for infections and complications from the original surgery.

As a result of her trauma, the woman is on daily pain narcotics and has difficulty controlling her bowels.
