NY Senator Proposes Legislation to Fill Recall Gap for Car Rentals
Legislators are responding to a need for strict regulations for rental car companies to repair recalled cars in their fleet prior to renting them to the public. Two California girls died tragically in a car crash in 2004 when their PT Cruiser caught fire and slammed into a semi-tractor trailer. The vehicle had been part of a recall for potential leaks in the steering mechanism that could ignite.
Enterprise rental company had previously rented the car four times after the recall.
Drivers in Binghamton, NY, should be aware that rental car companies are not required by law to repair recalled vehicles like auto purchases. Prior to renting a vehicle during this busy vacation time, NY drivers should research vehicle recall notices to limit auto accidents caused by defective vehicles on the highways.
NY Senator Charles Schumer has spearheaded legislation to close the gap for rental car companies’ failure to repair vehicles under recall. “This is a serious public safety issue and, tragically, we have already seen the grave and devastating consequences of inaction,” the Senator stated. Senator Schumer believes that his Safe Rental Car Act will help get these dangerous cars off our highways and prevent car accident injuries and fatalities.
Auto purchase companies are required by law to repair recalled vehicles prior to selling them. Absent similar legislation, rental car companies’ statistics for voluntarily repairing cars subject to recall are shockingly low. A National Highway Traffic Safety Administration audit revealed the following statistics:
- Hertz had only fixed 34% of rental cars under recall within 90 days;
- Avis/Budget had repaired only 53% of recalled cars under during the same time period; and,
- Enterprise had the highest repair record for recall notices with only 65% of their cars being repaired within 90 days.
“This bill is just plain common sense – rental car companies should not be in the business of renting cars that pose serious risks to drivers and passengers,” Senator Schumer said.
