Driver Inattention Blamed on Fatal New York Truck Accident

Published August 30, 2012 by Scott Gottlieb, Injury Law Attorney

Last month we reported on a deadly New York truck accident that resulted in six fatalities and left one man seriously injured. The accident occurred when the driver of a tractor-trailer crashed into an SUV that had slowed for highway construction in a work zone. Now, investigators report “the truck driver wasn’t paying attention” when he crashed.

According to news reports, the trucker had ample warning of the approaching construction area, but the driver did not notice the signs or slowed vehicles until it was too late to brake. The state Department of Transportation inspected the crash site after the accident and confirmed that the signage met department standards.

Review of the driver’s cell phone showed that no texts or calls had been made in the time leading up to the crash, and investigators are unsure what diverted the driver’s attention. The driver has not yet been charged in the accident.

Unfortunately, driver inattention, along with other driver-related factors, is a significant cause of tractor trailer truck accidents. The Federal Motor Carrier Safety Administration reports that the majority of truck accidents are caused by driver error.

In fact, 87% of fatal truck crashes evaluated in the Large Truck Crash Causation Study by the FMCSA were caused by driver error, and nearly a third of those accidents were due to driver inattention. Nearly 4,000 Americans die in large truck crashes each year.

Our Binghamton truck accident attorneys encourage all New York truck drivers to stay alert at all times when driving a big rig, especially when around construction zones. It is critically important to be cautious when driving an 80,000-pound vehicle.
