$35 Million Awarded To Family of Interstate Crash Victim

Published November 16, 2010 by Scott Gottlieb, Injury Law Attorney

The family of a woman killed four years ago when a tractor-trailer rig hit her car, has been awarded $35.25 million reports the Kansas City Star.

At the time of her death, the 55 year-old woman was with three other women who were on their way to a family celebration. While stopped for an accident on Interstate 70, the tractor-trailer, driven by a driver for the Michigan based CenTra Trucking Company, slammed into the car, killing all four women.

Attorneys for the woman claimed the driver was tired and that he falsified his logs to show he was properly rested. However, his cell phone records proved otherwise. The lawsuit claimed the trucking company was reckless in ignoring the man’s driving record and his failure to follow company guidelines.

The jury award included a $5.25 million compensatory verdict and $30 million in damages of the case.

The other family members settled their case in 2008 for a total of $18 million. They chose not to enter the punitive phase of the case.
