Drunk Driver Faces Negligent Homicide Charges After Fatally Injuring Five People in Upstate New York
The tragic deaths of five Amish farmers in Benton this week was caused by a drunk driver who ignored traffic laws and good driving sense. A 42-year-old man attempted to pass a slow-moving tractor when he sideswiped a van carrying 13 people after he failed to navigate a turn and return to the right lane. Emergency rescue efforts were hampered by the mangled condition of the van which was forced under the tractor.
Six injured passengers remain in the hospital, with 3 still in guarded condition.
All 50 states consider a driver drunk when his blood alcohol content is .08 or higher. Our Binghamton accident attorneys have been warning of the dangers of careless and drunk driving for some time.
Besides being charged with driving while intoxicated, the driver from Penn Yan was arraigned on five counts of criminally negligent homicide. He was also charged with reckless driving, unsafe passing, speed not reasonable and prudent, and failure to keep right after passing.
In 2009, nearly 11,000 people died in crashes in the US in which at least one driver had alcohol in their system. In New York during the same period, 28 percent of the nearly 1,200 car accident fatalities involved an impaired driver. These statistics continue to demonstrate the dangers on the road exhibited by unsafe, negligent drivers.
Our New York injury attorneys at Scott C. Gottlieb, Injury Law encourage Binghamton drivers to be wary on the roads and to call 911 if you witness someone driving erratically or dangerously.
