$31 Million Awarded in Ohio Medical Malpractice Lawsuit
The Dayton Daily News reports a $31 million medical malpractice verdict against Miami Valley Hospital, making it possibly the largest medical malpractice verdict in Ohio history. However, because of a confidential settlement agreement between the parties, the hospital probably won’t pay that amount.
Parents sued the hospital after their son, born in December of 2000, suffered permanent, irreversibly brain damage during his birth. The complaint claimed the hospital failed to monitor the labor properly even though the staff knew the mother was a high risk patient. The suit also claimed the staff failed to diagnose her hyper-stimulated uterus, gave her the drug Pitocin when it wasn’t needed, and did not tell the doctor of her inappropriate contraction patterns. During delivery, her uterus ruptured and her body stopped providing the baby oxygen – leaving him without oxygen for 18-20 minutes.
The boy has severe cerebral palsy, has to use a feeding tube, and needs 24-7 care.
